In this paper we examine the current state and likely future path of nanotechnology regulation by the U.S. Environmental Protection Agency (“EPA” or “the Agency”). We also explore a number of initiatives that have arisen in parallel with the development of a national regulatory program, that are intended to (i) generate information on the health and environmental effects of nanoscale materials, and (ii) control the potential adverse impacts of nanotechnology on health and the environment.
