We present an overview of recent trends in the prosecution of U.S. patent applications in the nanotech field. It is generally becoming more difficult to prosecute patent applications to allowance in most art units. Expected rule changes in the U.S. Patent Office may further complicate matters. We provide common-sense tips for building a valuable portfolio of patents in light of these expected changes. We also present patent allowance and issuance statistics and explain recent classification changes in the U.S. Patent Office affecting nanotech applications.
