Nanotechnology patenting at the European Patent Office: Information retrieval, trends and common examination issues

Abstract:
In reaction to the rising number of nanotechnology-related patent applications and their large technological diversity, the European patent Office (EPO) has created a tagging system for nanotechnology which enables monitoring of patent applications in various sectors relating to nanotechnology. Via the (free) online esp@cenet interface, anyone can perform patent-searches relating to nanotechnology using this tagging system. Some examples of this will be shown. In addition, trends in various aspects of filing of European patent applications in nanotechnology are presented. We have also identified a number of key substantive examination issues occurring with some regularity during prosecution of nanotechnology patent applications. Some EPO case-law (jurisprudence) relevant to aspects of patenting nanotechnology will be presented.
